These Terms govern your use of the SMDIQ-FINTECH website, web application, Telegram alerts and related services ("Services"), operated by SMD Fincorp, [registered address] ("SMDIQ-FINTECH", "we", "us"). By creating an account or using the Services, you agree to these Terms.
1. Nature of the Services
SMDIQ-FINTECH provides market data visualisation, quantitative analytics and educational tools for Indian equity derivatives and commodity markets. We are not registered with SEBI as an investment adviser, research analyst, stockbroker or portfolio manager. Nothing in the Services is investment advice, a research report, or a recommendation to buy, sell or hold any security or contract.
2. Eligibility
You must be at least 18 years old, resident in India or legally allowed to use the Services from your location, and able to enter a binding contract.
3. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. One subscription is for one individual. Sharing logins, simultaneous use from multiple people, or reselling access will result in suspension without refund.
4. Subscriptions and payment
Plans are billed in advance, monthly or yearly, at the prices shown at checkout, inclusive of applicable GST. Prices may change with at least 15 days' notice; changes apply from your next billing cycle. Refunds and cancellations follow our Refund & Cancellation Policy.
5. Your trading decisions
You alone decide whether to trade, and you bear all gains and losses. Any paper or live trading features are tools you control. Live orders, where offered, are placed through your own broker account and are subject to that broker's terms and applicable SEBI and exchange rules.
6. Market data
Data is sourced from licensed providers and brokers. It is provided for your personal, non-commercial use only. You may not copy, redistribute, resell, scrape or republish data, analytics, levels or alerts, including on Telegram channels, social media or other websites.
7. Acceptable use
You will not: reverse engineer or copy the platform; use bots or scrapers; attempt to break security; misrepresent our analytics as your own advice or tips to others; or use the Services for any unlawful purpose.
8. Intellectual property
All software, models, designs, text and trademarks, including "SMD", "IQ Engine" and "IQ Answer", belong to SMDIQ-FINTECH or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Services during your subscription.
9. Availability
We aim for high uptime during market hours but do not guarantee uninterrupted or error-free service. Feeds may be delayed or interrupted by exchanges, providers, brokers or networks. Scheduled maintenance will be done outside market hours where possible.
10. No warranty
The Services are provided "as is" and "as available". We do not warrant the accuracy, completeness or timeliness of any data, analytics, pattern detection or alert.
11. Limitation of liability
To the extent permitted by law, SMDIQ-FINTECH is not liable for any trading losses, lost profits, or indirect or consequential damages. Our total liability for any claim is limited to the subscription fees you paid in the 3 months before the claim.
12. Indemnity
You agree to indemnify SMDIQ-FINTECH against claims arising from your breach of these Terms or misuse of the Services.
13. Suspension and termination
We may suspend or terminate accounts that breach these Terms. You may stop using the Services at any time by cancelling your plan.
14. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-app at least 7 days before they take effect.
15. Governing law
These Terms are governed by the laws of India. Courts at [City], [State] have exclusive jurisdiction, subject to your rights under consumer protection law.
